PhotoBin Terms and Conditions

Please read these Terms and Conditions ("Terms," "Terms of Service") carefully before using the PhotoBin mobile application ("the App," "Service") operated by Bancha ("us," "we," or "our").

By accessing or using the App you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Description of Service

PhotoBin is a mobile application designed to help users manage and organize photos stored in their device's native photo library (e.g., Apple Photos).

The App includes the following core functionalities:

Discover Tab: Displays photos grouped by month for easy browsing.

PhotoBin Tab: Allows users to efficiently sort and manage photos by swiping left (to mark for deletion) or swiping right (to keep).

Deletion Management: Photos marked for deletion are added to a pending list. Upon confirmation within the App, these photos are moved to your device’s "Recently Deleted" folder, where they will remain for approximately 30 days before being permanently removed by the operating system.

Photo Actions: Users can add photos to Favorites, share them, or add them to new or existing albums, all while synchronizing with the native photos app.

Album Management: Users can create and delete albums directly within the App, which are reflected in the native photos app.

2. In-App Purchases (IAP)

The App may include optional in-app purchases, including subscriptions or one-time purchases, which grant access to additional features or functionality.

Billing: All purchases, billing, and subscription management are handled directly by the App Store (Apple) where you downloaded the App.

Refunds: All purchases are subject to the App Store’s refund policy. We do not handle refunds directly.

3. User Obligations and Content

A. Ownership of Photos

You retain all ownership rights to the photos and content you manage using PhotoBin. We do not claim any rights over the images stored on your device.

B. Device Storage

You are responsible for the capacity and performance of your device's storage. PhotoBin merely facilitates the management of photos already stored on your device.

C. Accuracy of Deletion

While PhotoBin provides tools to mark and delete photos, you are solely responsible for reviewing the items marked for deletion before confirming the final deletion action.

4. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

5. Disclaimer and Limitation of Liability

The App is provided on an "AS IS" and "AS AVAILABLE" basis. Bancha makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties. In no event shall Bancha be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the App.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your State/Country, or a standard jurisdiction like the State of California, USA, or remain generic], without regard to its conflict of law provisions.
